Terms & Conditions
All sales are subject to and expressly conditioned upon the terms and conditions herein, and upon customer’s assent thereto. The terms and conditions contained herein will be controlling, and any additional and/or inconsistent terms and conditions set forth in any acknowledgement, purchase order, or acceptance documents requested from and/or provided by customer are expressly rejected. No variation of these terms and conditions will be binding upon Capitol Scientific unless agreed to in writing and signed by an officer or other authorized representative of Capitol Scientific. Specific terms of sale include but are not limited to:
• Orders under $75.00 may be subject to processing and handling charges.
• Special packaging and handling fees including fuel surcharges and hazmat fees may apply.
• Prices are quoted excluding shipping, handling, and taxes.
• Product specifications are subject to change without prior notice.
Limited Warranty
All products are warranted by the manufacturer. We make no warranty and shall have no obligation except as stated in the Returned Goods Policy with respect to expendable or consumable parts and supplies. In no event will warranty cover damage caused by or resulting from accident, misuse, neglect, or unauthorized installation, alterations, or repairs to the products. Our sole responsibility and the purchaser’s exclusive remedy for any claim arising out of the purchase of any product in this catalog is repair, replacement, or credit, where applicable. In no event: (1) shall the cost of the exclusive remedy exceed the purchase price; (2) shall we be liable for any special, indirect, incidental, consequential, or exemplary damages, howsoever arising, even if we have been advised of the possibility of such damages.
Capitol Scientific makes no warranty, express or implied, that the products are merchantable, fit for a particular purpose, or that the products will conform to the illustrations or descriptions. No warranty or affirmation of fact, express or implied, other than as set forth in the limited warranty statement above is made or authorized.
Liability
Any liability for consequential or incidental damages is expressly disclaimed. Our liability in all events is limited to, and shall not exceed, the purchase price paid.
Payment Terms On approved credit, we offer NET 30 days from invoice date. Delinquent accounts will be subject to a service charge on past due amounts of one and one-half percent(1½%) per month (or, if less, the maximum amount permitted by law).
Quotations Special pricing on large quantities is available upon request. Contact us or use the quote cart for details. If your quoted price is not reflected within your web session while you are “logged-in” under your account, please contact us to have the update made.
Return Goods Policy
We strive for your complete satisfaction; however there are instances when returns are necessary.
• We must authorize all returns prior to returning. Customer Service will issue a return goods authorization number upon request.
• All returns may be subject to a minimum 20% restocking charge or more depending on the manufacturer’s Return Goods Policy.
• All returns must be sent prepaid (No COD’s are accepted).
• Return Authorization numbers are valid for 30 days.
• All chemicals must be returned according to proper DOT regulations.
• Credit will be issued upon return inspection. Item must be in original packaging and in saleable condition. Partial credit, return freight charges and restocking fees may apply. Non-stock, custom, and special orders are non-returnable.
Sales Tax Sales Taxes where applicable (local, state, federal) will be added to the invoice subtotal if applicable. We must have a valid tax exemption certificate on file if invoices are to exclude sales & use tax for that client.
Delivery & Freight Terms All shipments are made F.O.B. Origin with freight charges pre-paid and added to the invoice unless other arrangements or agreements are in place prior to shipment. Collect shipments via our client’s carrier of choice are always a viable option. Title of goods passes to recipient once it is signed for as “delivered” by the carrier.
Any damage claims are to be filed with the carrier whether the carrier was selected by Capitol Scientific or the consignee. Local deliveries made by Capitol Scientific cargo vans or trucks of orders under $300.00 will incur an minimum $12.00 “delivery fee” which is added to the final invoice. Higher delivery fees may be incurred for emergency deliveries or for orders that require special delivery conditions requested by the client.
